Monetary Claim
4) monetary claim – a claim by a construction participant regarding:
the refund of funds paid prior to termination of a contract providing for the transfer of a residential unit, and (or) funds in the amount equal to the value of property transferred to the developer prior to termination of such a contract;
compensation for damages in the form of actual damage caused by the developer's breach of the obligation to transfer a residential unit under a contract providing for the transfer of a residential unit;
the refund of funds paid under a contract declared invalid by a court or arbitration court and providing for the transfer of a residential unit, and (or) funds funds in the amount equal to the cost of the property transferred to the developer under such a contract;
return of funds paid under the contract deemed by the court or arbitration court to be unenforceable and providing for the transfer of residential premises, and (or) funds in the amount equal to the cost of the property transferred to the developer under such a contract;
