Inadmissible Evidence in a Criminal Case


1. Evidence obtained in violation of the requirements of this Code is inadmissible. Inadmissible evidence has no legal force and cannot be used as a basis for an accusation or to prove any of the circumstances provided for in Article 73 of this Code.

2. The following evidence is considered inadmissible:

1) statements by a suspect, accused person made during pre-trial proceedings in the absence of a defender, including cases where the suspect or accused person has waived the right to a defender and these statements are not confirmed by the suspect or accused person in court;

2) statements by the victim, witness based on guesswork, assumption, rumor, as well as statements by a witness who is unable to indicate the source of his knowledge;

3) other evidence obtained in violation of the requirements of this Code
