Principles Governing the Use of an Electronic Signature


The principles of using an electronic signature are as follows:

1) the right of participants in electronic interaction to use any type of electronic signature at their discretion, unless federal laws or normative legal acts adopted in accordance with them, or agreements between participants in electronic interaction provide for the requirement to use a specific type of electronic signature in accordance with its intended purpose;

2) the possibility for participants in electronic interaction to use, at their own discretion, any information technology and (or) technical means that allow compliance with the requirements of this Federal Law applicable to the use of specific types of electronic signatures;

3) the impermissibility of recognizing an electronic signature and (or) an electronically signed document as lacking legal force solely on the basis that such an electronic signature was not created manually, but rather using means of electronic signatures for automatic creation and (or) automatic verification of electronic signatures in an information system
