Preliminary Court Hearing in Civil Proceedings


1. The preliminary court hearing aims to processually confirm the procedural actions taken by the parties during the preparation of the case for judicial consideration, determine the circumstances relevant to the proper examination and resolution of the case, assess the sufficiency of evidence in the case, and examine the facts related to the missed deadlines for filing a claim with the court and the statute of limitations.

2. The preliminary court hearing is conducted by the judge alone. The parties are notified of the time and place of the preliminary court hearing. In the preliminary court hearing, the parties have the right to present evidence, submit arguments, and make applications.

3. For complex cases, taking into account the opinion of the parties, the judge may set a period for conducting the preliminary court hearing that exceeds the time limits established by this Code for considering and resolving cases.

4. In the presence of circumstances provided for in Articles 215, 216, 220, and paragraphs two through six of Article 222 of this Code, the proceedings in the preliminary court hearing may be suspended or terminated, and the claim may be left without consideration.

5. A court order is issued regarding the suspension of proceedings, termination of the case, or leaving the claim without consideration. A partial appeal may be filed against the court's order.

6. In the preliminary court hearing, the defendant's objection concerning the plaintiff's failure to meet the statute of limitations for protecting a right or the time limit established by federal law for filing a lawsuit may be considered.

If it is established that the statute of limitations or the time limit for filing a lawsuit has been missed without due cause, the judge issues a decision to dismiss the claim without examining other factual circumstances of the case. The court's decision may be appealed in the appellate proceedings.

6.1. When considering disputes regarding children at the request of parents (one of the parents) during a preliminary court hearing, the court, with the mandatory participation of the guardianship and custody authority, has the right to determine the place of residence of the children and (or) the order of exercising parental rights for the period until the court decision enters into force. In these matters, an order is issued upon receipt of a positive opinion from the guardianship and custody authority and with mandatory consideration of the children's opinions. If there are circumstances indicating that changing the actual place of residence of the children during the period until the corresponding court decision enters into force contradicts the interests of the children, the court determines the actual place of residence of the children as their place of residence for the period until the court decision determining their place of residence enters into force.

7. A protocol is drawn up on the conducted preliminary court hearing in accordance with Articles 229 and 230 of this Code
