Rights of the Aircraft Commander
1. The commander of the aircraft has the right:
1) to make final decisions regarding takeoff, flight, and landing of the aircraft, as well as to terminate the flight and return to the airport or to make an emergency landing in case of a clear threat to the safety of the flight of the aircraft in order to save human lives and prevent damage to the environment. Such decisions may be made deviating from the flight plan, instructions of the relevant authority of the unified air traffic management system, and the flight assignment, with mandatory notification of the relevant air traffic service authority (flight control) and, where possible, in accordance with established flight rules;
2) in order to ensure the safety of flight of the aircraft, issue instructions to any person on board the aircraft and require their compliance. The captain of the aircraft has the right to take all necessary measures, including coercive measures, against persons whose actions pose an immediate threat to the safety of the flight of the aircraft and who refuse to comply with the instructions of the captain of the aircraft. Upon arrival of the aircraft at the nearest airport, the captain of the aircraft has the right to remove such persons from the aircraft, and in the case of commission of an act constituting a criminal offense, hand them over to law enforcement agencies;
3) make decisions on fuel dumping during flight, dropping of baggage, cargo, and mail if this is necessary to ensure the safety of the flight of the aircraft and its landing. In the absence of appropriate aviation security services, the captain of the aircraft has the right to conduct pre-flight inspection of persons and objects referred to in Article 85 of this Code;
4) take other measures to ensure the safe completion of the flight of the aircraft
