Circumstances Mitigating Tax Liability


1. Circumstances that mitigate liability for committing a tax offense are considered to be:

1) commission of the offense due to the occurrence of serious personal or family circumstances;

2) commission of the offense under threat or coercion, or due to material, official, or other dependence;

2.1) difficult financial situation of a physical person held liable for committing a tax offense;

(subparagraph 2.1 introduced by Federal Law No. 137-FZ dated July 27, 2006)

3) other circumstances that may be considered mitigating liability by the court or tax authority examining the case
