Market value of the vehicle
MARKET VALUE - the most probable price at which a vehicle (or other types of products and services relating to vehicles) can be transferred on an open market under conditions of competition, when the parties to the transaction act reasonably, having all necessary information, and the price of the transaction is not affected by any extraordinary circumstances, i.e. when:
- one party to the transaction is not obliged to transfer the vehicle, and the other party is not obliged to accept performance;
- the parties to the transaction are well informed about the vehicle as the subject of the transaction and act in their own interests;
- the vehicle is offered on the open market through a public offer typical of identical vehicles. A public offer is considered to be a proposal containing all essential terms of the contract, from which it can be inferred that the person making the offer intends to conclude a contract under the conditions specified in the proposal with anyone who accepts it. Essential terms include specifying the subject matter of the contract (model, make, specifications of the vehicle), the price of the vehicle and the seller's details;
- the transaction price, which represents a reasonable remuneration for the vehicle and there was no coercion to enter into the transaction on the part of either party;
- payment for the vehicle expressed in monetary form
