Active foreign company


An active foreign company is a foreign entity for which the share of income specified in paragraph 4 of article 309-1 of this Code, for the period for which, in accordance with the personal law of this foreign entity, financial statements are prepared for the fiscal year, does not exceed 20 percent of the total amount of the entity's income according to such financial statements for that period (ceased to be effective as of May 1, 2019)1.
