Controlling person of the organization operating coal mines


The controlling party of an organization operating coal mines is a legal entity that has the right to directly or indirectly (through persons under its control) manage, based on participation in this organization and (or) pursuant to property management agreements, and (or) simple partnership agreements, and (or) mandates, and (or) shareholder agreements, and (or) other agreements, the subject of which is the exercise of rights confirmed by shares (stakes) of this organization, more than 50 percent of the votes in the highest governing body of this organization or the right to appoint (elect) a sole executive body and (or) more than 50 percent of the composition of the collegial governing body of this organization1.
