Non-compliance of candidates - non-compliance of candidates proposed for the specified positions with these qualification requirements is understood as: absence in them of higher legal or economic education and experience in managing a department, another subdivision of a credit organization, whose activities are related to the performance of banking operations, or absence of two years' experience in managing such a department, subdivision; presence of a criminal record for committing crimes in the field of economics; commission within one year preceding the day of submitting documents to the Bank of Russia for registration of a credit organization, an administrative offense in the area of trade and finance, established by a decision of an authority authorized to consider cases of administrative offenses that has become final; presence within two years preceding the day of submitting documents to the Bank of Russia for registration of a credit organization, of instances of termination of employment contracts (agreements) with these persons at the initiative of the administration on grounds, provided for in paragraph 2 of Article 254 of the Russian Federation Labour Code; submission, within three years preceding the date of submitting documents to the Bank of Russia for registration of a credit organization, to the credit organization in which each of the aforementioned candidates held the position of head of a credit organization, requirements for their replacement as head of a credit organization in accordance with the Federal Law "On the Central Bank of the Russian Federation (Bank of Russia)"; non-compliance of the business reputation of the aforementioned candidates with the requirements established by federal laws and regulations issued by the Bank of Russia in accordance therewith; presence of other grounds established by federal laws¹.
