Heirs of subsequent classes


1. If there are no heirs of the first, second, or third order (Articles 1142 - 1144), the right to inherit by law is acquired by relatives of the deceased who are related by the third, fourth, and fifth degree of kinship, not belonging to the previous orders of succession.

The degree of kinship is determined by the number of generations separating the relatives from each other. The birth of the deceased himself is not included in this count.

2. In accordance with paragraph 1 of this article, the following are called to inherit:

as heirs of the fourth order, relatives of the third degree of kinship - great-grandparents of the deceased;

as heirs of the fifth order, relatives of the fourth degree of kinship - children of the deceased's nephews and nieces (cousins' grandchildren) and the natural brothers and sisters of the deceased's grandparents (cousins' grandparents);

as sixth order heirs, relatives of the fifth degree of kinship - children of cousins' grandchildren and granddaughters of the decedent (great-grandchildren), children of his cousins (cousins' nephews and nieces) and children of his cousins' grandparents (cousin uncles and aunts).

3. If there are no heirs from previous orders, stepchildren, stepdaughters, stepfather and stepmother of the decedent are called upon to inherit as seventh order statutory heirs.
