Individually Initiated Syndicated Loan
2. An individually initiated syndicated loan refers to a loan provided by a bank (the original creditor) in its own name and at its own expense to the borrower, the rights to which (a part thereof) are subsequently assigned by the original creditor to a third party (parties) (banks - members of the syndicate) subject to the following conditions:
the share of each bank - member of the syndicate in the total volume of the rights to claim against the borrower (principal debt and interest on the loan) is determined by agreements between the banks - members of the syndicate and the original creditor, and is recorded in each individual assignment agreement concluded between the original creditor and the bank - member of the syndicate;
the procedure for actions by the banks - members of the syndicate in the event of insolvency (bankruptcy) of the borrower, including the enforcement against collateral or other security in case such exists, is defined by a multilateral agreement
