General Provisions
Environmental Impact Assessment (EIA) and ecological expertise represent key tools of legal regulation in the field of nature protection. These procedures allow for the identification and prevention of potential negative consequences of economic and other activities, ensuring a balance between economic development and the preservation of ecological safety. In Russia, their legal basis is formed by federal laws, codes, and subordinate acts, making them an important part of the state control system over natural resource utilization.
The EIA process includes a set of activities aimed at analyzing the potential impact of projects on the environment. During the procedure, information is collected and assessed regarding air quality, water conditions, soil status, as well as the impact on flora and fauna. Based on this data, measures are developed to prevent or minimize environmental damage, while public opinion is taken into account, which increases the transparency of decision-making and enhances public involvement in nature conservation.
Environmental expertise, on the other hand, represents an official analysis of documentation justifying the implementation of economic objects. It is conducted taking into account the principles of scientific justification, legality, independence, and transparency. The main purpose of the expertise is to prevent the implementation of projects capable of causing harm to the environment, which makes it an important tool for preventing environmental risks at all stages of planning and construction.
There are several types of environmental expertise. State environmental expertise (ГЭЭ) is conducted by authorized government bodies for strategically significant objects such as large industrial enterprises and hydro-technical structures. Public expertise is initiated by citizens and environmental organizations, serving as a supplementary control mechanism to ensure compliance with environmental standards and providing an opportunity to influence decisions regarding the implementation of projects.
The legal regulation of EIA (environmental impact assessment) and environmental expertise is based on the Federal Laws "On Environmental Protection" and "On Environmental Expertise", as well as the Land Code, Water Code, and Forest Code of the Russian Federation. Orders issued by the Ministry of Natural Resources of Russia clarify the procedures for conducting assessments and evaluation criteria. The comprehensive application of these tools ensures sustainable development, protection of natural resources, and compliance with citizens' environmental rights, creating an effective system for preventing and minimizing environmental damage.

EIA is a procedure during which possible environmental consequences of planned activities are analysed. The main tasks of EIA include:
- identification and assessment of potential environmental impacts;
- development of measures to prevent or reduce negative consequences;
- consideration of public opinion in decision-making.
Main stages of conducting an EIA (Environmental Impact Assessment)
- Determination of the assessment object (projected enterprise, construction, production modernization, etc.).
- Collection and analysis of initial data on the state of the environment.
- Evaluation of potential impacts (changes in air, water, soil, impact on flora and fauna).
- Development of measures for prevention and minimization of damage.
- Public discussions (citizens and organizations may submit proposals and comments).
- Preparation of the final EIA report and its submission to government agencies.
Environmental expertise
Environmental impact assessment represents a process of official consideration of documentation containing environmental aspects of activities. Its goal — preventing the implementation of projects capable of causing harm to the environment.
Environmental impact assessment is conducted on the basis of principles:
- scientific validity;
- legality and independence;
- publicity and public participation;
- preventiveness, i.e. prevention of environmental damage.
Types of Environmental Impact Assessment
- State Environmental Expertise (SEE) — conducted by authorized state bodies in relation to strategically important objects (construction of large enterprises, hydraulic structures, etc.).
- Public Environmental Expertise — initiated by citizens and public organizations and aimed at providing additional oversight of projects.
Legal Regulation of EIA and Environmental Expertise
The main normative acts regulating environmental impact assessment (EIA) and environmental expertise are:
- Federal Law "On Environmental Protection" (No. 7-FZ) — defines the principles of legal regulation of environmental impact assessment and EIA.
- Federal Law "On Environmental Expertise" (No. 174-FZ) — establishes procedures for conducting environmental expertise.
- Land, Water, and Forest Codes of the Russian Federation — regulate issues related to the use of natural resources taking into account ecological requirements.
- Orders of the Ministry of Natural Resources of Russia — establish specific procedures and criteria for impact assessment.
Environmental Impact Assessment and ecological expertise are important tools for preventing environmental risks. Their application contributes to sustainable development, protection of the environment, and observance of citizens' environmental rights.
