List of documents for challenging the results of determining the cadastral value of real estate in the Commission on Consideration of Disputes Concerning the Results of Determining Cadastral Value

Оспаривание результатов определения кадастровой стоимости недвижимости
To apply to the Commission, it is necessary to submit a statement requesting reconsideration of the cadastral value[1]. Along with the statement requesting reconsideration of the cadastral value, the following documents must be attached[2]:
- a cadastral extract containing information about disputed results of determining the cadastral value;
- notarially certified copy of a title or documentary evidence of ownership of the real estate, in cases where the statement requesting reconsideration of the cadastral value is submitted by a person having rights to the real estate;
- documents confirming the inaccuracy of information about the real estate used for determining its cadastral value, in cases where the statement requesting reconsideration of the cadastral value is submitted based on the inaccuracy of such information;
- a report prepared on paper and in the form of an electronic document, in cases where the statement requesting reconsideration of the cadastral value is submitted based on establishing the market value of the real estate;
- positive expert opinion in paper and electronic forms, prepared by an expert or experts from a self-regulating organization of appraisers, members of which are appraisers who prepared the report, regarding compliance of the appraisal report on the market value of the object with requirements of Russian Federation legislation on appraisal activities, including requirements of this Federal Law, federal appraisal standards and other acts of the authorized federal body responsible for normative legal regulation of appraisal activities, as well as requirements of appraisal standards and rules of such self-regulating organization of appraisers in cases established by this authorized federal body, and in accordance with the procedure provided for in the procedure for establishing and operating the commission (such expert opinion must be submitted if the market value of the real estate differs from its cadastral value by more than thirty percent).
A statement requesting reconsideration of the cadastral value without attachment of the specified documents is not considered. Other documents may also be attached to the statement requesting reconsideration of the cadastral value.
