List of documents for challenging the results of determining the cadastral value of real estate in the Commission on Consideration of Disputes Concerning the Results of Determining Cadastral Value

To apply to the Commission, it is necessary to submit an application for reconsideration of the cadastral value¹. Along with the application for reconsideration of the cadastral value, it is necessary to attach²:

• a cadastral certificate containing information about the disputed results of determining the cadastral value of the real estate object;
• a notarized copy of the title-deed or document confirming ownership of the real estate object, in cases where the application for reconsideration of the cadastral value is submitted by a person having rights to the real estate object;
• documents confirming the inaccuracy of information about the real estate object used in determining its cadastral value, in cases where the application for reconsideration of the cadastral value is submitted on the basis of the inaccuracy of such information;
• a report prepared on paper and in the form of an electronic document, in cases where the application for reconsideration of the cadastral value is submitted on the basis of determining the market value of the real estate object;
• a positive expert opinion in paper form and as an electronic document, prepared by an expert or experts of a self-regulating organization of appraisers, member of which is the appraiser who prepared the report, regarding compliance of the appraisal report on the market value of the subject of appraisal with the requirements of Russian Federation legislation on appraisal activities, including the requirements of this Federal Law, federal appraisal standards and other acts of the authorized federal body responsible for normative legal regulation of appraisal activities, as well as the requirements of appraisal standards and rules of such self-regulating organization of appraisers in cases established by this authorized federal body, and in accordance with the procedure for establishing and operating a commission (this expert opinion must be submitted in cases where the market value of the real estate object differs from its cadastral value by more than thirty percent).

A statement requesting a reconsideration of the cadastral value is not accepted for consideration without attaching the specified documents. Other documents may also be attached to the statement requesting a reconsideration of the cadastral value.
