Administrative respondents in cases challenging the results of determining the cadastral value of real estate


Administrative respondents in cases concerning the determination of cadastral value at the level of market value are state body or body of local self-government, which approved the results of cadastral value determination, and state body performing functions in accordance with state

cadastral valuation.

In the event of challenging the results of determining the cadastral value due to unreliable information about the object of evaluation, the organ responsible for correcting cadastral or technical errors is also involved in the case.

In cases regarding reconsideration of cadastral value of objects specified in Article 24.19 of the Law on Valuation Activities, the interested party (administrative defendant) is the organ performing functions related to state cadastral valuation.

In cases involving challenges to decisions, actions (inaction) of the Commission, interested parties (administrative respondents) are Commission and state organ, performing functions in state cadastral valuation, where it was established.

The court involves other persons whose rights and obligations may be affected by the court's decision. For example, the owner, co-owner, former owner, or co-tenant of real estate (article 47 and part 3 article 247 of the Civil Procedure Code of the Russian Federation (KAS RF)).
