Calling an appraiser as a witness in the case of disputing the results of determining cadastral value
In order to eliminate ambiguity in the provisions of the appraisal report, the court resolves the issue of summoning as a witness the appraiser who conducted the state cadastral appraisal and (or) prepared the report on the market value of the disputed real estate object, as well as the expert from the self-regulating organization of appraisers who issued a positive conclusion regarding the corresponding report (article 69 of the Russian Code of Administrative Procedure).
According to the meaning of paragraph 2 of Article 84 of the Russian Federation Code of Civil Procedure (КАС РФ) an expert conclusion of a self-regulating organization on an appraisal report does not have for the court a predetermined force and is evaluated on equal terms with other evidence (paragraph eight of Article 17.1 of the Law on Appraisal Activities).
