Special Conditions Regime in Correctional Institutions

1. In cases of natural disaster, the introduction of a state of emergency or martial law in the area where the correctional facility is located, during mass disturbances, as well as during group disobedience by inmates, a special regime may be introduced in the correctional facility.

2. During the period of the special regime in the correctional facility, certain rights of inmates provided for in Articles 88 - 97 of this Code may be suspended, enhanced security and supervision measures may be introduced, a special order of access to facilities may be implemented, the daily routine may be changed, the activities of production, communal, cultural and educational services, as well as other services, except for medical and sanitary ones, may be restricted.

3. The special conditions regime is introduced for a period of up to 30 days at the decision of the head of a federal executive authority body performing law enforcement functions, functions of control and supervision in the area of serving criminal penalties by convicts, or the head of the territorial body of the penal execution system of a subject of the Russian Federation, coordinated with the General Prosecutor of the Russian Federation or the relevant prosecutor. In exceptional cases, the duration of the special conditions regime may be extended by these officials for an additional 30 days on grounds specified in the first part of this article.

4. In the event of an immediate threat to the life and health of convicts, staff members, or other persons, the head of the correctional facility may independently introduce measures provided for in the second part of this article, with immediate notification to the official authorized to make such a decision. In this case, the aforementioned official shall make a decision on the introduction of special conditions regime or on the cancellation of the introduced measures within three days from the date of receiving the notification.
