Guarantee Deposit (Contribution)

6.2.2. guarantee deposit (contribution) - a deposit (contribution) placed with the credit institution - creditor by a legal entity that has unfulfilled monetary obligations to the credit institution or obligations arising (which may arise) as a result of the performance by the credit institution of a conditional credit obligation undertaken by it (hereinafter - main obligations), as well as a deposit (contribution) placed with the credit institution - creditor by a legal entity that has, under a guarantee agreement or pursuant to a bank guarantee, obligations to ensure proper fulfillment of the main obligations, provided that the following conditions are simultaneously met:

there are no obstacles to the termination of obligations through set-off of claims related to the guarantee deposit (contribution), including the absence in the deposit (contribution) agreement of a condition regarding the possibility of early repayment (demand) of the deposit (contribution);

The term for the refund of a deposit (contribution) by a legal entity - borrower (counterparty under a conditional obligation of a credit nature, as well as a legal entity that has obligations towards a credit institution under a guarantee agreement or due to a bank guarantee regarding the performance of primary obligations) commences no earlier than the occurrence of the term for the fulfillment of its obligations towards the credit institution and no later than 30 calendar days after the occurrence of this term;
