Futures Contract (Contract)


6. A futures contract is a contract concluded on exchange trading that provides for the obligation of each party to the contract to periodically pay monetary amounts depending on changes in price (prices) and (or) value (values) of the underlying (base) asset and (or) occurrence of circumstances that constitute the underlying (base) asset.

7. A futures contract, in addition to the conditions established by paragraph 6 of this Regulation, may also provide for:

the obligation of a party to the futures contract to transfer to the other party securities, currency or goods that constitute the underlying (base) asset, including through the conclusion by the party (parties) to the futures contract, and (or) by the person (persons) for whose benefit the futures contract was concluded, of a securities purchase and sale agreement, a foreign currency purchase and sale agreement, or a goods supply agreement; or

The obligation of the parties to a futures contract (agreement) to enter into a contract that is a derivative financial instrument and constitutes the underlying (base) asset.

8. A futures contract (agreement) providing for the obligation established by paragraph 7 of this Regulation, except for the obligation to enter into a contract that is a derivative financial instrument which does not provide for an obligation to deliver, purchase (sell) or supply securities, currency or goods, is a physical delivery contract. Other futures contracts (agreements) are settlement contracts.

A futures contract is a document defining the rights and obligations to receive (transfer) property (including money, currency values, and securities) or information with specifications of the procedure for such receipt (transfer). Obligations under a futures contract to receive (transfer) property or information are terminated upon acquiring a homogeneous futures contract providing for the corresponding transfer (receipt) of the same property or information, or upon their fulfillment. Futures contracts may be traded only on exchanges.
