Forward contract (contract) over-the-counter

10. An over-the-counter forward contract (agreement) is a contract concluded outside of exchange trading and providing for:

1) the obligation of one party to the contract to transfer securities, currency or goods that are the underlying (base) asset to the other party's ownership no earlier than three days after the date of conclusion of the contract, the obligation of the other party to accept and pay for such property, and a statement that the contract is a derivative financial instrument; or

2) the obligation of one party to the contract to transfer securities, currency or goods that are the underlying (base) asset to the ownership of the other party no earlier than three days after the date of conclusion of the contract, the obligation of the other party to accept and pay for such property, as well as the obligation of the parties or a party to the contract to periodically and/or one-time pay monetary amounts depending on changes in price(s) and/or value(s) of the underlying (base) asset and/or occurrence of circumstances that are the underlying (base) asset; or

3) the obligation of the parties or a party to the contract to periodically and/or one-time pay monetary amounts depending on changes in price (prices) and/or value (values) of the underlying (base) asset and/or occurrence of an event that is an underlying (base) asset.

11. An over-the-counter forward contract (agreement) providing for the obligation established by subpoint 1 or 2 of point 10 of this Regulation is a delivery contract. Other over-the-counter forward contracts (agreements) are settlement contracts.
