Gauptschutz
1. A gaupthwaht is a specially equipped facility for the detention of military personnel specified in paragraphs 2 and 3 of this appendix, under conditions of isolation in cases provided for by Russian Federation legislation. A gaupthwaht may be garrison or military (ship-based).
2. Military personnel detained at the garrison gaupthwaht include:
those subjected to disciplinary arrest for a period specified in the court's decision;
those sentenced to arrest with serving the punishment on the gaupthwaht;
persons charged with the commission of crimes (hereinafter, the term "charged persons" includes the terms "defendants" and "convicted persons", unless otherwise provided in the relevant paragraphs of this appendix); suspects of having committed a crime or those detained under court order - no more than 48 hours from the moment of detention or arrest; in cases where the court postpones the decision on the imposition of pre-trial detention in the form of custody for a suspect or charged person, military personnel may be held on the guardhouse for another not more than 72 hours from the date the court makes such a decision; in exceptional circumstances, when it is impossible to transfer military personnel detained under arrest to a pre-trial detention facility due to remoteness or lack of adequate transportation routes, they may be held on the guardhouse for up to 30 days. Convicted military personnel are kept on the garrison guardhouse until the conviction becomes legally enforceable;
detained military personnel.
3. The military (ship) guardhouse is established by an order of the commander of the garrison (commander of the unit) when there are not enough places available at the garrison guardhouse and is equipped only for the detention of suspects and accused persons who have been subjected to disciplinary arrest and detained soldiers (seamen) and non-commissioned officers (sergeants), applicable in accordance with what is stated for the garrison guardhouse.
