Deprivation of liberty


1. Deprivation of liberty consists in isolating the convicted person from society by placing him in a colony-settlement, placing him in a corrective educational colony, a therapeutic correctional institution, a general, strict or special regime correctional colony, or in a prison. A sentence of deprivation of liberty may be imposed on a person who has committed for the first time a crime of minor severity only if aggravating circumstances provided by Article 63 of this Code are present, except for crimes provided for by paragraph 1 of Article 228, paragraph 1 of Article 231 and Article 233 of this Code, or only if deprivation of liberty is provided as the sole type of punishment by the corresponding article of the Special Part of this Code
