Torture


1. Causing physical or mental suffering through systematic beatings or other violent acts, if this has not resulted in the consequences specified in Articles 111 and 112 of this Code,

is punishable by restriction of freedom for a term up to three years, or compulsory labor for a term up to three years, or deprivation of liberty for the same period.

2. The same act committed:

a) in relation to two or more persons;

b) in relation to a person or their close relatives in connection with the performance by that person of official duties or fulfillment of public duty;

c) in relation to a woman known to the offender to be pregnant;

d) in relation to an obviously minor or a person known to the offender to be in a helpless state or in material or other dependence on the offender, as well as a person who has been kidnapped or taken hostage;

e) with the use of torture;

e) by a group of persons, by a group of persons acting in concert or by an organized group;

g) for hire;

h) motivated by political, ideological, racial, national or religious hatred or hostility or by hatred or hostility towards any particular social group,

is punishable by deprivation of liberty for a term of between three and seven years
