Syndicated loan without defining share conditions
3. A syndicated loan without defined participation terms refers to a loan granted by the bank organizing the syndicated lending (hereinafter referred to as the syndicate organizer bank) to the borrower in its own name in accordance with the conditions of the credit agreement concluded with the borrower, provided that the syndicate organizer bank concludes a credit agreement with a third party (third parties), in which it is stipulated that such third party (such third parties):
undertakes (undertake) to provide the syndicate organizer bank with funds no later than the end of the business day during which the syndicate organizer bank is obliged to provide the borrower with funds in accordance with the terms of the credit agreement in an amount equal to or less than the amount provided by the syndicate organizer bank to the borrower on that day;
is entitled to demand payments in respect of the principal debt, interest, and other payments in an amount equal to that in which the borrower fulfills its obligations to the bank - syndicate organizer in respect of repayment of the principal debt, interest, and other payments under the credit provided by the bank, not earlier than the moment when the corresponding payments are actually made
