Creditor's default


1. A creditor is deemed to be in default if he has refused to accept proper performance offered by the debtor or has not performed actions provided for by law, other legal acts, or the contract, or arising from business customs or the nature of the obligation, without which the debtor could not have fulfilled his obligation.

A creditor is also deemed to be in default in the cases specified in paragraph 2 of article 408 of this Code.

2. The debtor has the right to claim compensation for damages caused by the creditor's default, unless the creditor proves that the default occurred due to circumstances for which neither he himself nor those persons who, under law, other legal acts or at the request of the creditor, were responsible for accepting performance, are liable.

3. With respect to a monetary obligation, the debtor is not obliged to pay interest for the period of the creditor's default.
