h) "Biological and Chemical Weapons (BCW)" means:
a) "biological weapons", which are:
i) microbiological or other biological agents or toxins, regardless of their origin or method of production, of such types and in such quantities that are not intended for prophylactic, protective, or other peaceful purposes; or
ii) weapons, equipment, or delivery systems intended for the use of such agents or toxins in hostile purposes or in armed conflict;
b) "chemical weapons", which are collectively or individually:
i) toxic chemicals and their precursors, except in cases where they are intended for:
A) industrial, agricultural, research, medical, pharmaceutical, or other peaceful purposes; or
B) protective purposes, namely purposes directly related to protection against toxic chemicals and protection against chemical weapons;
C) military purposes not related to the use of chemical weapons and not dependent on the use of the toxic properties of chemicals as a means of warfare; or
D) law enforcement purposes, including combating domestic unrest, provided that the types and quantities correspond to such purposes;
ii) ammunition and devices specifically designed for lethal effects or causing other harm due to toxic properties referred to in subparagraph (b)(i) of toxic chemicals released as a result of the use of such munitions and devices;
iii) any equipment specifically designed for direct use in connection with the use of the munitions and devices mentioned in subparagraph (b)(ii);
c) nuclear weapons and other nuclear explosive devices;
