The share of a foreign holding company in an economically significant entity

The share of a foreign holding company's participation in an economically significant organization is taken to be equal to its share on the date the arbitration court issues a decision to suspend the exercise of corporate rights by the foreign holding company with respect to the economically significant organization, without taking into account the distribution of shares (interests in the charter capital) of the economically significant organization among persons who have acquired (acquiring) direct ownership of these shares (interests in the charter capital), and/or their accounting as the company's own shares (interests in the charter capital belonging to the economically significant organization)1.
