A short-term recording of a work — is not considered a reproduction if the short-term recording of the work is temporary or accidental and constitutes an integral and essential part of a technological process whose sole purpose is the lawful use of the work or the transmission of the work by an information intermediary between third parties in an information and telecommunications network, provided that such recording does not have independent economic value1;
