Aggravating circumstances of criminal punishment
1. Aggravating circumstances are considered to be:
a) recidivism;

b) the occurrence of serious consequences as a result of committing the crime;
c) commission of the crime by a group of persons, a group of persons acting in concert, an organized group or a criminal community (criminal organization);
d) active participation in the commission of the crime;
e) involvement in the commission of the crime of persons who suffer from severe mental disorders or are under the influence of alcohol or other intoxicating substances, as well as persons who have not reached the age at which criminal liability arises;
f) commission of the crime motivated by political, ideological, racial, national or religious hatred or hostility, or motivated by hatred or hostility towards any social group;

e.1) commission of a crime out of revenge for lawful actions by other persons, as well as with the aim to conceal another crime or facilitate its commission;

g) commission of a crime against a person or their close relatives in connection with the performance by that person of official duties or fulfillment of a public duty;
z) commission of a crime against a woman known to the offender to be pregnant, as well as against a minor, another helpless or vulnerable person, or a person dependent on the offender;
i) commission of a crime with particular cruelty, sadism, torture, or infliction of suffering on the victim;
k) commission of a crime using weapons, ammunition, explosives, explosive or imitation devices, specially manufactured technical means, narcotic substances, psychotropic, potent, toxic and radioactive substances, medicinal and other chemical-pharmaceutical preparations, as well as by applying physical or psychological coercion;

l) commission of a crime under conditions of emergency, natural disaster or other public calamity, as well as during mass disturbances;
m) commission of a crime using the trust granted to the offender due to his official position or contract;
n) commission of a crime using the uniform or documents of an authority representative;
o) commission of intentional crimes by employees of internal affairs bodies;

p) commission of a crime against a minor by a parent or another person who is legally obligated to raise the minor, as well as by a teacher or other employee of an educational, upbringing, medical, or other institution that is obliged to supervise the minor
