Private individuals
For the purposes of this Model Law, "civilian persons" mean:
1) during an international armed conflict - persons who are not members of the armed forces of a party to the conflict as defined in Article 43 of the Additional Protocol (I) to the Geneva Conventions of 12 August 1949, relating to the Protection of Victims of International Armed Conflicts, adopted on 8 June 1977, and who do not belong to any of the categories of persons specified in Article 4 "A" (1), (2), (3) and (6) of the Geneva Convention relative to the Treatment of Prisoners of War of 12 August 1949;
2) during a non-international armed conflict - persons who are not members of the armed forces of a party to the conflict, who do not take direct part in hostilities, as well as persons who, although being members of the armed forces of a party to the conflict, have voluntarily laid down their arms or have been rendered hors de combat for any other reason.
In case of doubt regarding the status of an individual, it is considered a civilian. The presence among the civilian population of individuals not falling under the definition of civilians does not deprive this population of its civilian character
