Use of a phonogram


2. The use of a phonogram is considered to be:

1) public performance, that is, any communication of the phonogram by means of technical devices in a place open to free access or in a place where a significant number of persons not belonging to the usual circle of family are present, regardless of whether the phonogram is perceived at the place of its communication or elsewhere simultaneously with its communication;

2) broadcasting, that is, communication of the phonogram for general information by means of its transmission by radio or television (including retransmission), excluding cable communication. For the purposes of this definition, "communication" shall mean any action by which the phonogram becomes available for auditory perception regardless of whether it is actually perceived by the public. When a phonogram is broadcast via satellite, broadcasting shall be understood as the reception of signals from a ground station to a satellite and the transmission of signals from the satellite by means of which the phonogram may be brought to general knowledge regardless of whether it is actually received by the public;

3) cable transmission, that is, the communication of a phonogram for general information by its transmission via radio or television through cable, wire, optical fiber or similar means (including retransmission);

4) making the phonogram available to the public in such a way that an individual may access the phonogram from any place and at any time of his or her own choosing (making available to the public);

5) reproduction, that is, the production of one or more copies of the phonogram or part of the phonogram. In this context, recording the phonogram or part of the phonogram on an electronic medium, including recording in the memory of a computer, is also considered reproduction, except in cases where such recording is temporary and constitutes an integral and essential part of a technological process whose sole purpose is lawful use of the recording or lawful making available to the public of the phonogram;

6) distribution of a phonogram by means of sale or other transfer of ownership of the original or copies of the phonogram on any material medium;

7) import of the original or copies of the phonogram for the purpose of distribution, including copies made with the authorization of the rights holder;

8) hire of the original and copies of the phonogram;

9) adaptation of the phonogram
