Transfer of the policyholder's right to compensation for damage (subrogation)
1. Unless otherwise provided for in the property insurance contract, the insurer who has paid the insurance indemnity shall acquire, within the amount paid, the right of claim that the insured (beneficiary) has against the person liable for damages compensated as a result of the insurance. However, a contractual provision excluding the transfer to the insurer of the right of claim against the person intentionally causing damage is void.
2. The right of claim transferred to the insurer shall be exercised by the insurer in accordance with the rules governing relations between the insured (beneficiary) and the person liable for damages.
3. The insured (beneficiary) is obliged to provide the insurer with all documents and evidence, and to inform the insurer of all information necessary for the insurer to exercise the transferred right of claim.
4. If the insured (beneficiary) has waived their right to claim against the party liable for damages compensated by the insurer, or if exercising this right has become impossible due to the fault of the insured (beneficiary), the insurer is released from paying the insurance compensation in full or in part and is entitled to demand the return of any overpaid amount of compensation
