Jurisdiction of the State
State jurisdiction - the rights of judicial and administrative authorities of a state to consider and resolve cases in accordance with their competence. In international law, territorial and personal (national) jurisdiction are distinguished. The former is exercised within a certain territory. Within its own territory, a state has full jurisdiction, except in those cases where applicable international agreements provide otherwise. Personal (national) jurisdiction is exercised by the state over its citizens located outside of its territory, for example, on the high seas, in Antarctica, or in outer space. In cases provided for by national legislation, state jurisdiction extends to the citizens of that state even when they are located on foreign territory; however, this jurisdiction may be exercised only within the territory of the state itself, unless otherwise provided for by an international agreement.
