Damage caused during maritime transportation of dangerous and harmful substances
"Damage" means:
a) death of any person or injury to a person on or off the ship carrying dangerous and noxious substances as a result of exposure to such substances;
b) damage or loss to property outside the ship carrying dangerous and noxious substances as a result of exposure to such substances;
c) damage or loss resulting from pollution of the environment caused by dangerous and noxious substances, provided that compensation for damage to the environment, excluding lost profits arising from such damage, is limited to costs incurred in taking reasonable remedial measures which have been actually taken or should be taken; and
d) costs of preventive measures and subsequent damage or loss caused by such preventive measures.
In cases where it is not reasonably possible to separate the damage caused by hazardous and noxious substances from the damage caused by other factors, all such damage shall be deemed to have been caused by hazardous and noxious substances, unless the damage caused by other factors is not of the type specified in paragraph 3 of article 4.
In this paragraph, "as a result of the effect of these substances" means "as a result of the hazardous or harmful nature of the substances"
