Retroactive Effect of Criminal Law


1. A criminal law that removes the criminal nature of an act, mitigates punishment, or otherwise improves the position of a person who has committed a crime is retroactive, meaning it applies to persons who have committed the relevant acts before the entry into force of such law, including those serving or having served a sentence but having a criminal record. A criminal law that establishes the criminal nature of an act, increases punishment, or otherwise worsens the position of a person does not have retroactive effect.

2. If a new criminal law mitigates the punishment for an offence being served by a person, then this punishment shall be reduced within the limits provided by the new criminal law
