Auction for the Conclusion of a Contract
1. For the purposes of this Federal Law, an auction for the right to conclude a contract means a tender in which the winner is considered to be the party offering the lowest price of the contract, except for the cases provided for by paragraphs 6.1 and 6.2 of article 37 of this Federal Law.

2. The auction may be open or closed. The customer, the authorized body is entitled to place an order by conducting an open auction in accordance with the procedures established by this chapter, or by conducting an open electronic auction in accordance with this Federal Law. The customer, the authorized body is entitled to place an order by conducting a closed auction exclusively in the case of placing an order for the supply of goods, performance of works, or provision of services, information about which constitutes state secrets, provided that such information is contained in the auction documentation or in the contract draft, and in the cases of placing orders for the provision of services related to insurance, transportation, and security of valuables of the State Fund of Precious Metals and Precious Stones of the Russian Federation, for the provision of services related to insurance, transportation, and security of museum items and museum collections, rare and valuable publications, manuscripts, archival documents (including copies), having historical, artistic or other cultural significance and transferred by customers for temporary possession and use or for temporary use by physical and legal entities, including in connection with the organization of exhibitions on the territory of the Russian Federation and/or territories of foreign states.
