Negligence


1. Negligence, that is non-performance or improper performance by an official of his duties due to dishonest or careless attitude towards service, if this has caused significant damage or a substantial violation of the rights and legitimate interests of citizens or organizations or protected legal interests of society or the state,

is punishable by a fine of up to one hundred and twenty thousand rubles or in the amount of the offender's salary or other income for a period of up to one year, or compulsory work for a term of up to three hundred and sixty hours, or corrective labor for a term of up to one year, or arrest for a period of up to three months.

2. The same act, resulting in serious harm to health or death of a person due to negligence,

shall be punished by compulsory labor for a term of up to five years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years or without such deprivation, or by restriction of freedom for a term of up to five years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years or without such deprivation.

3. The act provided for by paragraph 1 of this article, resulting in the death of two or more persons through negligence -

shall be punished by compulsory labor for a term of up to five years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years or without such deprivation, or by restriction of freedom for a term of up to seven years with deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years or without such deprivation.
