Imposition of adverse contract terms on the counterparty
Thus, "imposing on the counterparty disadvantageous terms of the contract" refers to the act of an organization occupying a dominant position sending a contract with terms that are disadvantageous for the counterparty, which the counterparty lawfully disputes; however, this organization refuses or avoids negotiating and accepting the counterparty's proposals. It is precisely the insistence by the organization in a dominant position on the terms of the contract it has proposed that constitutes an abuse of a dominant position in the form of imposing disadvantageous or discriminatory terms of the contract on the subscriber.
