Dominant position


1. A dominant position is considered to be the position of an economic entity (group of persons) or several economic entities (groups of persons) on the market for a certain product, giving such economic entity (group of persons) or such economic entities (groups of persons) the ability to exert decisive influence over the general conditions of trade for that product on the relevant product market, and/or to remove other economic entities from this product market, and/or to hinder access to this product market by other economic entities. A dominant position is considered to be the position of an economic entity (excluding a financial organization):

1) whose share on the market for a certain product exceeds fifty percent, unless in considering a case of violation of antitrust legislation or during state supervision over economic concentration it is established that, despite exceeding this figure, the position of the economic entity on the product market is not dominant;

2) the share of which on the market of a certain good is less than fifty percent, if the dominant position of such economic entity has been established by an antitrust authority based on the unchanged or subject to insignificant changes share of the economic entity on the goods market, the relative size of shares on this goods market belonging to competitors, the possibility of access to this goods market by new competitors, or based on other criteria characterizing the goods market
