Monopolistically high price
1. A monopolistically high price of a product is a price set by an economic entity occupying a dominant position, if this price exceeds the amount of expenses necessary for the production and sale of such product and profit, as well as the price that has formed under competitive conditions on a comparable commodity market, characterized by similar composition of buyers or sellers, terms of goods circulation, access to the commodity market, state regulation, including taxation and customs-tariff regulation (hereinafter - comparable commodity market), provided that such a market exists within the territory of the Russian Federation or beyond its borders, including prices established:
1) by increasing the previously set price of the product, if at the same time the following conditions are met together:
a) expenses necessary for the production and sale of the product have remained unchanged or their change does not correspond to the change in the price of the product;
b) the composition of sellers or buyers of the goods has remained unchanged or the change in the composition of sellers or buyers of the goods is insignificant;
c) the conditions for circulation of goods on the goods market, including those conditioned by measures of state regulation, including taxation, tariff regulation, have remained unchanged or their change is disproportionate to the change in the price of the goods;
2) by maintaining or not reducing the previously established price of the goods, provided that the following conditions are met simultaneously:
a) the costs necessary for the production and sale of the goods have significantly decreased;
b) the composition of sellers or buyers of the goods makes it possible to change the price of the goods in the direction of reduction;
c) the conditions for circulation of goods on the goods market, including those conditioned by measures of state regulation, including taxation, tariff regulation, make it possible to change the price of the goods in the direction of reduction

A monopolistically high price on a monopolized market is a price set by the manufacturer (supplier) occupying a dominant position on this market, which is higher than the minimum possible price,- QN.
A monopolistically high price is established in this case for the purpose of compensating costs related to the maintenance of underutilized production capacities and (or) excess labor force, and (or) losses associated with the destruction of goods, creation of artificial shortages, as well as for obtaining excessive profits
