International Conciliation Procedure


3. For the purposes of this Law, "conciliation procedure" means a procedure which may be termed conciliatory, mediating or denoted by a term of similar meaning, and within which the parties request a third party or parties ("mediator") to assist them in an attempt to achieve a peaceful settlement of their dispute arising from contractual or other legal relations or connected therewith. The mediator does not have the authority to prescribe the parties to resolve the dispute.
4. A conciliation procedure is international if:
a) at the time of its conclusion, the commercial enterprises of the parties to the agreement on the conciliation procedure are located in of different states; or
b) the state where the commercial enterprises of the parties are located is not:
i) a state where a significant portion of the obligations arising from the commercial relationship should be performed;
ii) a state with which the subject matter of the dispute is most closely connected.
