1. A monopolistically low price of a product is a price set by an economic entity occupying a dominant position, if this price is lower than the sum of expenses necessary for the production and sale of such product and profit, and lower than the price formed under competitive conditions on a comparable product market, provided that such a market exists within the territory of the Russian Federation or beyond its borders, including prices established:

1) by reducing a previously set product price, provided that the following conditions are met simultaneously:

a) expenses necessary for the production and sale of the product have remained unchanged or their change does not correspond to the change in the product price;

b) the composition of sellers or buyers of the product has remained unchanged, or a change in the composition of sellers or buyers of the product is insignificant;

c) the conditions of goods circulation on the commodity market, including those conditioned by measures of state regulation, including taxation and tariff regulation, have remained unchanged or their change is disproportionate to the change in the price of the goods;

2) by maintaining or not increasing the previously established price of the goods, provided that the following conditions are met simultaneously:

a) the costs necessary for the production and sale of the goods have significantly increased;

b) the composition of sellers or buyers of the goods makes it possible to change the price of the goods in the direction of an increase;

c) the conditions of goods circulation on the commodity market, including those conditioned by measures of state regulation, including taxation and tariff regulation, make it possible to change the price of the goods in the direction of an increase
