Right of limited use of another's land plot (servitude)

General Provisions

According to Article 23 of the Land Code of the Russian Federation, servitude is established in accordance with civil legislation.

Public servitude is established by law or another normative legal act of the Russian Federation, a normative legal act of a subject of the Russian Federation, or a normative legal act of a local self-government body in cases where this is necessary to ensure the interests of the state, local self-government, or local population, without expropriating land plots. The establishment of a public servitude is carried out taking into account the results of public hearings.

Public servitudes may be established for:

  1. passage or transit through land plot, including for ensuring free access by citizens to a water body of public use and its shore zone;

  2. use of the land plot for repair of communal, engineering, electrical, and other lines and networks, as well as transport infrastructure objects;

  3. placement on the land plot of boundary and geodetic marks and approaches to them;

  4. carrying out drainage works on the land plot;5) extraction (removal) of water resources from water bodies and stock watering.
