Carrier of Dangerous Goods
The term "carrier" means:
a) In relation to road and inland waterway transport: a person who, at the time of the incident, controls the operation of the vehicle transporting dangerous goods.
It is presumed that the operation of the vehicle is controlled by the person in whose name the vehicle is registered in the state register, or, in the absence of such registration, the owner of the vehicle, unless they prove that another person controls the operation of the vehicle, and specify the name of this person, or, if it is impossible to specify the name, prove that
such another person operated the vehicle without his consent and under circumstances where he could not reasonably have prevented such use. In the case where a vehicle carrying hazardous goods is transported by another vehicle, the carrier shall be considered to be the person operating that other vehicle.
b) In relation to rail transport: the person or persons operating the railway line on which the incident occurred; in the case of joint operation, the carrier shall be each of the parties involved in
