Damage caused by the carriage of dangerous goods
The term "damage" means:
a) the death of any person or infliction of any bodily injury on or off the vehicle carrying dangerous goods, as a result of exposure to such goods;
b) loss or damage to property outside the vehicle carrying dangerous goods, caused by such goods, excluding loss or damage caused to other vehicles belonging to the same fleet of vehicles, or loss or damage caused to property located on such vehicles;
c) loss or damage resulting from environmental contamination caused by dangerous goods, provided that compensation for damage to the environment, excluding loss of profit arising from such damage, is limited to costs incurred for reasonable measures taken to restore the environment;
d) costs of precautionary measures and subsequent losses or damage caused by such precautionary measures.
In cases where it is not reasonably possible to distinguish between damage caused by dangerous goods and damage caused by other factors, all types of such damage are considered as being caused by dangerous goods.
