Capital Investment
2. The term "capital investment" means all kinds of tangible and intangible assets that are invested by investors from one Contracting Party on the territory of another Contracting Party in accordance with the legislation of the Contracting Party where such capital investments are made, including, but not limited to:
a) movable and immovable property, as well as property rights, such as ownership, mortgage, pledge, and other similar rights;
b) securities, shares, deposits, quotas, and other forms of participation in the capital of organizations;
c) claims for monetary funds or other rights having economic value and related to capital investments;
d) exclusive rights to intellectual property objects, including copyright, patents, trademarks, trade names, industrial designs, technical processes, information constituting a trade secret, know-how;
e) stable business relationships;
(e) rights to engage in business activities granted on the basis of legislation, a contract or authorization issued by a competent authority of the relevant Contracting Party in accordance with its legislation, including rights to exploration, development, extraction or exploitation of natural resources.
No change in the form of investment affects their qualification as investments, provided that such change does not conflict with the legislation of the Contracting Party on whose territory the investments are made.
