Property liability for environmental violations represents a form of civil liability aimed at compensating damage caused to the environment, health, or citizens' property. It applies when contractual obligations are breached or when harm is caused outside contractual relations, ensuring restoration of violated rights and ecological balance.
According to current legislation, everyone has the right to a favorable environment and compensation for damage caused by environmental violations. Compensation for damage is provided in full extent and includes both actual harm and lost profits, while liability may be imposed not only on the person causing the harm but also on other persons involved in activities leading to the violation of environmental standards.
The Federal Law "On Environmental Protection" establishes the obligation of legal and physical persons to compensate for damage caused by pollution, depletion, degradation, or spoilage of natural resources. The amount of compensation is determined taking into account actual costs for restoring the environment's condition, approved methodologies or reclamation projects, and in their absence – based on actual expenses and losses.
Judicial practice shows that property liability may be solidary in nature: both the client and the party performing the work may be simultaneously held liable if their joint actions caused harm to the environment. At the same time, grounds for exemption from liability are absent if the violation occurred within the framework of economic activity, even if the works were carried out under a state contract.
The main objective of property liability is to restore the disturbed ecological state and prevent repeated violations. Such a mechanism stimulates participants in economic activities to strictly adhere to environmental norms and ensures a balance between economic interests and the preservation of natural resources for society.
