Land plots within particularly protected natural territories (OOPТ) are restricted in circulation if there is no information regarding the boundaries of settlements included within them in the Unified State Register of Real Estate (EGRN).
Land plots within the territory of a populated area included in the composition of a specially protected natural territory are restricted in circulation, if the EGRN does not contain information on the boundaries of this populated area.
Citizen challenged in court the refusal of the regional ministry of property and land relations to grant preliminary approval for the transfer into ownership of a land plot designated for individual housing construction, motivated by its location within the boundaries of a state natural reserve of federal importance.
Leaving the citizen's claim unsatisfied, the court referred to Article 6 of Law No. 505-FZ dated December 30, 2020, according to which the provisions of Article 3.1 of the Law on Protected Natural Areas (OOPZ) and Articles 27 and 95 of the Russian Federation Code of Administrative Offenses (KоАП РФ) in the version amended by Law No. 505-FZ dated December 30, 2020 apply to populated areas, information on the boundaries of which has been entered into the Unified State Register of Real Estate (USRR).
Thus, land plots on territory of a populated area included within the scope of ООПТ are restricted in circulation if the EGRN (Unified State Register of Real Estate) does not contain information about the boundaries of this populated area.
The land plot requested by the citizen falls within the boundaries of a special natural area of federal significance (OOPT), located within the boundaries of a populated area. However, according to data from Rosreestr, information regarding the boundaries of populated areas included in this reserve is absent in the Unified State Register of Real Estate (EGRN).
Under these circumstances, there were no grounds for recognizing the challenged decision of the regional ministry of property and land relations as unlawful.
