Fee-Based Employment Agency
1. For the purposes of this Convention, the term "paid employment agency" means:
a) employment agencies with commercial objectives, i.e. any person, company, institution, agency or other organisation acting as an intermediary for placing a worker in employment or providing workforce to an employer, with a view to obtaining direct or indirect material benefit from such worker or employer; this definition does not apply to newspapers or other publications, except those whose sole or main objective is to act as an intermediary between employers and workers;
b) employment agencies that do not have for commercial purposes, i.e. recruitment services of any company, institution, agency or other organisation which, without seeking material gain, charge employers or employees an entrance or periodic fee or any other levy.
2. This Convention does not apply to the employment of seafarers.
