Public Servitude


A public servitude is a servitude established in relation to a land plot by law or another normative legal act of the Russian Federation, a normative legal act of a subject of the Russian Federation, or a normative legal act of a local self-government body, for the purpose of ensuring the interests of the state, local self-government, or the local population. In the normative legal acts referred to in this paragraph of the Methodological Guidelines, the authority that established the servitude may be required to pay the person whose land plot is burdened by the servitude a proportionate fee for the servitude, and the amount of this fee may also be specified.

public servitude - the right of limited use of another's land plot (real estate object) in the interests of an indefinite group of persons, established by law or other normative act of the Russian Federation, normative act of a subject of the Russian Federation, normative act of a local self-government body taking into account the results of public hearings in cases where this is necessary to ensure the interests of the state, local self-government or local population, without expropriation of land plots.
